Consultant deducted salary

Hello All,

I was working for a IT company through one consultant from last 5 months. The project which I was working on was stopped by client and our team of our 60 guys were told to stop working from 10th March 2022. After that we were told that we will be put on some or other projects.

Now the other guys (working directly on company payroll) got full month's salary even others like my working through other consultant (by their consultant company), but my company paid me 1/4 th salary only. Can I have any legal option here in this situation so as the consultant pay me full salary. I am sure the consultant got full salary from company but not paying me.

Unless the agreement or contractual conditions are studied, precise guidance is not possible.  Contact a local advocate for more guidance and issue a registered notice, for recording the version of the opposite party.

There was no contract as such. One very basic Offer letter mail was sent -

We are pleased to offer you the position of  Senior Software Engineer at 

xxx

forward with great anticipation to your contribution to the success of our company.

Annual CTC will be Rs.xxx other statutory deductions are borne by you, salary will be reviewed periodically as per company policy. You shall have no claim of wages or benefits from any client of xxx, you are expected to join us on and before the 8th Nov 2021 at 10.00 am.This is subject to your commitment that you will be working with us for a minimum of 12 months of the period from the date of joining.

Even if there is a written contract, the employer is liable for salary as promised.
