I am the opposite party 1 in the District Consumer forum, where in the complaint filed by the complainant  in the month of April now the forum passed the Ex parte order for me alone for non appearence, but the case was conducted between opp2&3 and the complainant,

whether should i file set aside petition in the district consumer forum or to the state consumer forum?

The limitation period (30 days) for filing a set aside petition is already over. But you may file the petition with another petition called Condone Delay Petition. After it is allowed, the set aside petition will be taken up for consideration.

you    should    file   appeal   before   the   STATE   CONSUMER   COMMISSION    to  set      side   the   reasoned        ORDER    passed    by    the    DCDRF      with    condonation    of   delay    by   sufficient    cause.

Petition to set aside the exparte order along another petition to condone the delay, are to be filed in the same court, i.e District consumer Forum.

Thanks a lot for your reply sir, should i file petition u/s 22A of consumer protection act?
