Counter IPC 211 during 498A - Judgement

 

REFERRING TO THE BELOW LINK OF THIS RESPECTED FORUM. PLS COULD ANYONE SEND ME A COPY OF ANY CASE WHERE THE HUSBAND HAS FILED COMPLAINT U/S 211 AND 511 IN THE SAME COURT DURING THE PROCEEDINGS OF 498A AS MENTIONED ON THE BELOW LINK.

The husband can move an application under section 340 cr.p.c in the court where proceeding under section 498a are in progress because offence of section 211 ipc is committed in the court and the magistrate after enquiry is convinced that a coplaint [s necessary in the interest of justice, the magistrate himself will file the complaint or sent it toother court. Please read provision of section 195 (1)(b) and sectiom 340 cr.p.c and that will clear your doubt
