1. an investor client has filed a complaint against trading member at consumer forum.
2.kindly advice whether an investor who trade in share market comes within the defination of the consumer or not.
3. there is agreement between investor and trading member to refer the dispute to NSE and BSE. can inevstor still file the complaint before consumer forum?
3.in case of any case law is there on this subject matter, kindly forward it.

Investor is a consumer as he also engages/avails services for a consideration.
An agreement to refer the matter/dispute to arbitration or pendency of arbitration proceedings is not a bar for the jurisdiciton of consumer forum to entertain a consumer complaint.
