Wife living separately for more than 5 yrs. Not filed for case for Sec 9 HMA ? What facts tentamount to desertion ? Husband gone to her place personally and had meetings through well wishers intervention ? What efforts on the part of husband should be to show his efforts to bring wife back ? Usefull for all the prospective sufferers ?

It is called "animus deserendi". Factum of desertion with intention to desert. It is to be proved.When the husband has strained his every nerve to bring back his wife and still if the wife refuses, then the factum can be proved, of course the well-wisgers speak to the said fact and the reaction of the wife for the mediation before the mediators. What ultimately has to proved that the wife has left the company of the husband without any reasonable or probable cause
