Can any one tell me that the respondent had filed a W.S.cum counterclaim in a divorce suit and the original address of the pettiioner ( wherefrom the suit was filed) was not given and the present residing address has been given. A copy was sent to the present address by us. We have been told that the counterclaim will be dismissed because of wrong address. Can it be done just because the address was incorrect without giving an opportunity to rectify the same? The present address has been taken from another divorce suit filed by the same petitioner in a different court which we have prayed for stay( as this was subsequently done). What recourse is available to us in case the counterclaim is dismissed?
