divorce

intercaste marriage took place in 1982. due to intense pressure from bride's family , immediate estrangement and total separation took place even before marriage is consummated. bride's whereabouts not known. since then no contact in any form took place. what is the solution & what are the legal rights of the man?

Section 23 (2) talks about reconciliation.  The exemption is given from reconciliation proceedings for the divorce cases fall under clause (ii) to (vii) of sub-section 1 of Section 13 and "mutual consent" divorce case does not come under exemption category.

The consent of both parties to waive off reconciliation proceedings is not requirement.  The requirement is that the judge has to be convinced either by the parties or by their advocates that in this matter reconciliation would be mere waste of time.

There is law that if u are not aware about your spouse from the last more then seven years then court can give you divorce.

IF YOUR SPOSE'S WHERE ABOUT IS NOT KNOWN FOR MORE THAN SEVEN YERS YOU FILE DIVORCE PETITON IN PROPER COURT.YOU WILL GET DECREE OF DIVORCE.
