Hi Learned counsels. My great grandfather has an ancestral property with 11 children's, my grandmother is one of the eldest children and has been passed away. My grandmother has 3 children out of the 3 , 2 others have joined hands to sell the property by leaving my mom who is supposed to get 1/27th right. We have filled a case in the court requesting for the partition, the honab'le judge has ordered for the emergent notice S/S to the defendants, the defandants are avoiding the summons for al most 3 months and also planning to sell the suit schedule property. Can they sell the property while the case is in pending status? In this regard what are the remedies which are available here to my mother?
1. Can we go to the location and put up a board for stating that this land is under litigation with the O/S number.
2. Can we pray Honable Judge to use Whatsapp as the means to serve the notice?
3. What in case if they sell the land by excluding my mom what legal remedies can we have?
