Hi Experts,

If a person who is not named in the FIR is sharing FIR copy on whatsapp group then what remedy is available to the person whose name is in the FIR?

FIR is a public document, which is available on public domain hence no action can be initiated against the person who is not named in the FIR but having a copy of FIR.

What is the harm in holding copy of FIR by a non-concerned person ?

FIR is a public document.  However, the intention of the person who is sharing such a public document counts. What was his/her intention? Is there a need or necessity for him to share it on Whatsapp or he is sharing it like a joke or similar to that on WhatsApp with bad intention against the person named in the FIR? Is it just for information or with a view to insult a person named therein? Although a public document, nobody has an automatic right to circulate it showing the person named therein in a bad light, as it is a mere FIR and nothing is proved at this stage.

You can not make case of defamation.
