Fraud tenant

We have let out a tenant 1 1/2 years before for a 11 month agreement . But still he has not vacated ,inturn he has filed a case against us......saying we are not allowing to live him at piece. We even has returned the money of 50000 rupees paid as advance  by way of cheque. We are good so far ...but he has taken all the mental peace of us .

Just now we have filed RCOP and the case is on ...if the case would take 2 years to get complete , what the agreement of 11 months plays. Why is that the law in india is in favour of tenant only and takes the peace of owners.

Having the political background he is doing all this .....When will all this law which was enacted 40 years back can be rewritten according to todays people life.....the law has to change time by time according to the peoples changing life ....our law can hold good only for 40 years back ...currently only who are planned well in fraud activities making use of such laws.......

hi sujeesh,

listen friend u r completely protected under law. but it depends if u r staying in maharashtra state then u r protected under Maharastra rent control act 1999.as per sec.25 of Maharashtra Rent Control Act , u can recover ur premices from u r tenant. but the point is to show reasonable cause show to the court. u must show some reasonable cause to the court why u want the premices vacated.one more thing u have the strong point dat u have the agreement so as per terms and condition u can recover u r premices and besides this there are so many ways to recover ur premices so dont worry.

Sir,

The law of Leave & Licence is very explicit about the eviction of the Licensee on expiry of the Licence period, If you have registered the Leave & Licence agreement you need not worry. You can file an eviction suit and recover the possession of your premises. During the pendency of the suit you are entitled to recover double the amount of rent agreed in the deed of Leave & Licence.
