Frivolous or Malicious litigation

Page no : 2

Gaurav Arora (Advocate)     03 November 2009

Mr. Sanjeev...its not a private complaint....in which the court may proceed ex parte against the complainant......an FIR was registered.....its a state case......For prosecution to prove its case, its necessary to bring the complainant in the witness box.....otherwise the whole exercise of the prosecution will be futile....thats why they are continuously sending summons to the complainant to appear before the court.....

ADVOCATE MAHESH VASWANI (President)     06 January 2010

Hey, you can move High Court for quashing the proceedings under Sec. 482 of Cr.P.C. and Article 226 of the Constitution....

If further queries persist do get in touch with me on 9821610888.

Yes. Years and years and years to pass before court has time to see your application.
