Having 2 different father's

Hi,

I have a step sister. and she is fighting for suscession of the property. Now she was born in may,1957 to my mother. My mother married my father in 1964, where i was born in dec, 1968. my father had brought all the property on my mothers name. he passed away in 1976. now, my mother too has passed away in 2006. there are no records showing my mother has brought us up with her income. i have my parents ( my father and mother's ) marriage cerficate. my step sister soon after my mother's death files a case against me stateting that i am after the property ( i have been staying with my mother along with my son, born in jan,1996 ) and she has the right for suscession. we are Christian by religion. Please help me and guide the right way.

The property is in your mother's name.  Who funded that property is immaterial.  For all purposes, it was your mother's property.  Your mother did not leave any WILL before dying.  Therefore, the property will go by way of inheritance amongst the legal heirs of your mother.

The legal heirs of your mother are her son(s) and daughter(s).  Your 1957 born step-sister is undoubtedly your mother's daughter.  That she was born to a different father than yours will have no bearing.

The fact remains that your step-sister is also the daughter of your mother and therefore she is an eligible legal heir to inherit the property left behind by your mother.  All the legal heirs will have to share the property equally.
