How to use citations

I am father of the child(4 year old son) applied for child custody. Plz clarify me on this :

1) Should I use only those citations wherein fathers are awarded child custody from Mother? If so, the circumstances of the cases should match closely?

2) Can I use useful paragraphs of the citations even though the judgement at the end go against the father?

3) Enlighten me on the procedure to present the citations to the court and at what point of time and how they can be used.

True........... agreed with Ashish, do not do any experiments with filing citations in the court. If you feel some citation is relevant, then show it to your lawyer and let him decide whether it should be filed or not.

 Every state has its own laws in regards to paternity, father's rights and adoptions. The Colorado and Utah courts have been fighting over this case for four years and One latest decision brings the father one step closer to gaining custody of his little girl.

Agree with Ld Adv Archana.  Everyone's case is unique.  You have to claim yourself to be the natural father and the guardian. You have to only write how much you love your child, how you will take care of the child and what you have done in the past for the welfare of the child, and what you will do for the welfare of the child in the future.  A young child like yours need mother's care and affection.  If there are other females in your family like your mother or other females point out that they will be helping you.  Show the circumstances under which the mother may not be able to take the custody of the child - but do not make any wild allegations.

 

Please avoid doing this just by yourself, as it could be counter-productive.  A competent advocate is necessary to fight your case, because for a child in tender years (5 years and younger) the mother is the custodian according to Hindu Minors and Guardianship act, assuming you are a Hindu.
