Improper society formation charges

Hi All,

I reside at Badlapur, thane district since last 3 years. My query is regarding society formation charges. While taking possession of my flat i paid all amount to builder as per agreement and received the possession letter from him.

Due to deficiency in services i have filed a case in consumer forum against builder. Although the builder gave me possession letter stating that i have paid all the amount as per agreement but now he is making false allegations stating i do not want to pay society formation charges hence i have filed a case against him. Builder after 3 years is taking signature from flat owners to form the society and he did not even called me for signing the document.

                Now according to my neighbor who was called for signing the society formation document builder has collected different amount from different flat owners in the name of society formation.  For example,

Flat Owner A – Rs 35000,

Flat Owner B – Rs 50000,

Flat Owner C – Rs 40000,

Flat Owner D – Rs 35000

                My question is whether it is legally right for builder to collect different amount from different flat owners for society formation. What can be done against builder if this is a wrong practice?

Note: Builder has collected society charges in cash from 95% flat owners including me.
