Infringement analysis

Dear all,

First invention:  A formulation comprising two active ingredients along with some excepients (Combination patent)

second invention: A formulation comprising one of the first inventions active ingredient with qualitatively similar excepients.

Does the second invention infringes the first one?

My first reaction is it is NOT infringement. However I would urge you to make further enquiries whether the active ingredient you chose to drop is an optional one?
