Wife filed false dv case against husband and in-laws. Later on husband paid some money to wife and entered into compromise. So all cases are withdrawn by wife 2 years back. Wife had extra marital affair with other guy
Now ex in-laws wants to file IPC 209 case against wife? Can they file? Please let me know. What will be the process for the same and which Judge they need to approach since case is already withdrawn.
IPC 209 says
209. Dishonestly making false claim in Court.—Whoever fraudulently or dishonestly, or with intent to injure or annoy any person, makes in a Court of Justice any claim which he knows to be false, shall be punished with imprisonment of either description for a term which may extend to two years, and shall also be liable to fine.
