If a Muslim woman insist for marriage under the Special Marriage Act,1954 even with the unmarried Muslim man, the Sharia law will not apply to the couple and the Husband will not be able to get married again during his existing marriage under the Act of 1954.

This will prevent polygamy and the first wife will feel safe in the monogamous marriage with the Muslim husband which otherwise according to Sharia law she would not be feeling.
