I need a judgement related to the case which i narrate below. My client had filed the divorce case against his wife and the same is pending. Simultaneously, his wife filed an application for interim maintenance in the above said divorce case as I.A. Following this interim maintenance was ordered against the husband. Subsequently there was a compromise arouse between the husband and wife and the divoce case which was filed by the husband was withdrawn. After reunion, again they got separated, and the interim maintenance which was ordered earlier was reopened and she filed an E.P. petition against the husband which is pending now.
We need a judgement regarding once the O.P was withdrawn automatically the I.A which lies inside the O.P became in-fructous and an E.P which is filed is not maintainable.
