Negotiable Instruments Act 1881 - sections 20 and 138 - dishonour of inchoate stamped cheque- Name of payee and amount not written by petitioner ,as claimed - Blank cheque signed by petitioner given as security and not for presenting for encashment withour prior consent- Blamk cheque, signed by drawer, called inchoate stampedinstrument ,having prima facie authority to holder to make or complete it,as per section20- payment cannot be denied - signed on cheque has not been disputed- no need for verification of handwriting by which name of payee and amount filled up- revision in High court being second revision in this case, it barred under 397(2) , Criminal Procedure code as infirmity in order of session court has fou nd
