Letter of administrator

 A  petition  for  Letters  of  Adminstration  is  filed  in  the  case  of  Intestate  Succession. A  person  is  deemed to have  died  intestate  in  respect  of  any  property  where  he  has  not  left  a  will.  The  manner  of  devolution  of  property  of  an  intestate  other  a  Parsi, is  clearly  set  ou in  Sections  33 to  49  of  the  Indian  Succession  Act,  1925.  In  the  case  of  Parsis, it is  covered by  Sections  50  to 56  of  the  Act.

         If  the  Intestate  has  left  no  next  of  kin(none  who  are  of  kindred  to him), his  property  shall go  to  the  Government.   

       The  Petition  for Letters  of  Administration  has  to  be  filed  under  Section  278  of  the  Act  and  under Sub-section  1 of  this  section, diclosing  the  information  requierd  under  clauses (a)  to (f).

         Not  everybody  has  a  ration  card  and  there  may be  people  who  may  not  have  any  school  record  but  a  person  claiming  to  be  a  relative  should  be  able  to  establish  how  he  is  related  to  the  deceased-  he  ought  to  be  in  a  position  to  show  the  family  he  comes  from and  in  what  way  the  deceased  is  connected  with  him.  Merely  filing  an  affidavit  and  an  Indemnity  Bond  will  not  suffice.

Thank you very much for your valuable reply. How can we challenge this Letter Of Administration ? Because none of the Govt. departments are giving us proceedings of this LOA & how her name is showing on Property card ? What documents did she file at collector office  to get her name reflect on the property card. We have asked it under RTI...collector office replied we have lost that file & we have no records today. How should we proceed in this case ? Can you plz guide ? Thanks
