one party filled a 138 against my party for the cheque bounce for insufficent funds, cheque was issued against goods which was sold by complainant to accused.. notice is still not framed... matter was referred to mediation .. where complainant after 3 years of case took back all the goods sold... mediation still going on but complainant after taking back goods demanding too much of amount as a compensation which is not acceptable
what will be the liabilty under 138 NI ... will liability remains after returning every single good...
