Maintanance

Dear Advacates,

I am sujith Staying in Faridabad I got MArried in April 2012 And after 3 months my wife gone back to her home and we blessed with a baby boy on february 23,2013 now she filed a domestic violence case against me in delhi metopolitain magistrate court and pls advice me is there a possbilty that court can pass a order that my wife will stay at her house and i have to pay maintanance,becoz i am calling her to me and she and her father are not allowing her to come to my home they are asking me to stay with her family

settle the matter amicably and stay elswhere other wise you have to face the trial and pay the maintenance.

The Code of Criminal Procedure, 1973 (CrPc)

125. Order for maintenance of wives, children and parents.

(1) If any person leaving sufficient means neglects or refuses to maintain-

(a) his wife, unable to maintain herself, or

(b) his legitimate or illegitimate minor child, whether married or not, unable to maintain itself, or

(c) his legitimate or illegitimate child (not being a married daughter) who has attained majority, where such child is, by reason of any physical or mental abnormality or injury unable to maintain itself, or

(d) his father or mother, unable to maintain himself or herself,
