One of my cheque was bounced due to the reason of it is a non cts. But i've sufficient fund. if they go to court will it come under sec. 138

If you have sufficient funds but the cheque was bounced by the bankers for some technical reasons which are beyond your control or the reasons are not attributable to your intentional act attracting the provisions o section 138 of Negotiable Act, you can, in your reply to the legal demand notice express your willingness to settle the amount due o the payee in the due course in the time fixed and in the manner as agreed upon by both, this will solve the issue.
