pagdi system

hello everyone,

i had a question on padgi system. in my building the landlord is not in india for many years. So the staff of the landlord transfers all the properties by themselves. It is not clear if they have the power of attorney of the landlord. The staff is not willing to show their power of attorney papers. In this case, how can we  verify the same. and in case they do not have the power does all the transfers they have done along with stamp duty get nullified?

Dear Raj,

The Pagdi system you are referring is not legal.  In so far the crosscheck of the title of the property is concerned for ascertaining the ownership chain one has to resort to property search with Sub Registrar's  Office and Local Municipal office (For mutation purposes).  If in case you can't find the Registered documents the unregistered documents cannot be legally considered to be the authenticated one.   I hope your query stands satisfied.
