Subject: Petition for Stay/Ban on Strike by Doctors
Brief Facts:
I am a resident of Jaipur. SMS Hospital is a leading Govt Hospital of Rajasthan. I like many others regularly visit the hospital for all my ailments because of its very reasonable fee structure and Good Doctors.
Because if the frequent mass leaves and strikes by resident Doctors the services of this Hospital are frequently disrupted causing great hardship to patients like me who cannot afford the costly private doctors.
Query
Can I bring a civil suit in the District Court against the Doctors Association restraining them from going on mass leave as a measure of their agitation to press their demands?
Can I bring a civil suit against the Government asking for a suitable remedy? What could be the remedy / prayer in this case?
(Please note that I am not interested in a PIL in the High Court)
