Power of trial court for video recording

Sir/Mam

The Opponent's Advocate misbehaved while asking cross - questions and denied for his acts

Hence the Complainant made application for further trial (cross/adducing evidence) under video recording

Opponent did not file any Reply thereto and No say Order was passed against Opponent

But Magistarte asked to show provisions that he (Magistarte) is empowered to order for video recording

hence kindly guide

If  yours is a criminal case pending before the trial court, trial has to take place on day-day basis. As per recent Supreme Court guidelines in Pradyuman Bisht vs. UOI & Ors. (WP Cr. 99/2015)  directions were passed by Division Bench of AK Goel & UU Lalit to ensure that all trial courts are mandatorily obliged to install video cameras within premises & inside courtrooms to ensure transparency in judicial proceedings.Evidence of professionals & witnesses must be recorded through videoconferencing St. of Maharashtra vs. Praful B Desai. Cite these precedents before the Magistrate
