Procedure for registering a solemnised hindu marriage

Kindly explain the procedure for registering a solemnised Hindu Marriage in Maharashtra.

(The groom has been residing in Mira-Bhayander City, Maharashtra for more than 6 months prior to the date of marriage i.e. 16th November, 2016. The bride resided in Ahmedabad for more than 6 months prior to marriage. The marriage was solemnised in Ahmedabad.)

Is there a prescribed format to be issued by the priest who solemnised the marriage? Please provide a proforma for such a Certificate from a priest. 

Can the marriage be registered online with the intent to bypass corrupt government officials and red-tapism?

Please provide the name, designation and address of the registering officer for practical purposes.

Introduction

A Marriage Certificate is a significant document that offers proof of marriage. In most jurisdictions, a marriage certificate is issued by a government official only after the civil registration of the marriage. It is the proof of registration of a marriage.

A marriage which has already been solemnised can be registered either under the Hindu Marriage Act, 1955 or under the Special Marriage Act, 1954. The Hindu Marriage Act is applicable in cases where both the husband and the wife are Hindus, Buddhists, Jains or Sikhs, or in cases where they have converted into any of these religions. In case either the husband or the wife or both are not Hindus, Buddhists, Jains or Sikhs, the marriage is registered under the Special Marriage Act, 1954. Further, the marriage can be solemnised between any two persons under the provisions of the Special Marriage Act, 1954.

Eligibility

  • Either Bridegroom or Bride can register their marriage.
  • Bridegroom/Bride should have completed 21/18 years respectively

Instructions

A marriage certificate is the official record that two people have undertaken a marriage ceremony. To obtain the marriage certificate first you need register your marriage.

Marriage certificate indicates that the couple is legally married.

  • In India, a legal marriage is between males older than 21 years of age and females older than 18 years of age.
  • In India, marriage can be registered in accordance to the Hindu Marriage Act, 1955 or Special Marriage Act, 1954.

Marriage registration certificates are being issued by the Additional-Divisional Magistrate(ADM) in whose jurisdiction either the husband or the wife resides.

Required Information

  • Name and address of bridegroom and bride,
  • Signature of bride and bridegroom,
  • Signature of 3 attesting witness present at the time of marriage along with their name and address,
  • Joint photo of bride and bridegroom with signature over such photo

Procedure

Hindu Marriage Act

  • Fill up application form.
  • Submit form along with all necessary documents.
  • Verification of all the documents is carried out on the date of application and a day is fixed and communicated to the parties for registration.
  • On the said day, both parties, along with a Gazetted Officer who attended their marriage, need to be present before the SDM.
  • The Certificate is issued on the same day.

 

Special Marriage Act

  • Fill up application form.
  • Submit form along with all necessary documents.
  • Both parties are required to be present after submission of documents for issuance of public notice inviting objections. One copy of notice is pasted on the notice board of the office and copy of the notice is sent by registered post to both parties as per address given by them.
  • Any person may within 30 days of issue of notice , file objection to the intended marriages. In such a case, the SDM shall not solemnise the marriage until he has decided the objection, within 30 days of its receipt. If the SDM refuses to solemnise the marriage, any of the parties may file an appeal within 30 days to the District Court. In case no objection is received, the SDM solemnises the marriage after 30 days of the notice.
  • Both parties along with three witnesses are required to be present on the date of registration. It is advisable to submit names of witnesses at least one day in advance.

Required Documents

  • Age proof
  • Residence Proof has to be from the state where the individuals are getting married. The individuals should have lived in the city for a minimum of six months.
  • Voter ID
  • Passport
  • Driving licence
  • Landline bill
  • Property Bill
  • Ration Card
  • 3 witnesses who are not related to either of the marrying parties.
  • 9 photographs each.

Fees

Rs. 100/- in case of the Hindu Marriage Act and Rs.150/- in case of the Special Marriage Act is to be deposited with the cashier of the district, and the receipt to be attached with the application form.

Validity

Marriage certificate is valid forever.

Processing Time

You should be getting a response normally within 15 days in case of registration of marriage under Hindu Marriage Act and 60 days under Special Marriage Act.
