my name is kishore,,

hai frnds


recently 2 months ago  my mother expired of cancer, and a month ago my father 61 yrs old got married to a

women aged 38 yrs,,, ,,, now i have a elder brother ,, he is married and got  twins aged 3 months , my

father have have a residential property , where me and my bother live,,with lots pain and difficulty my

mother contributed to this house,,,,, and now she is no more,, and my father got married to a women 38

years old,, now what rights do my fathers second wife have on this property which we live in .since this property is in

my fathers name, plz reply

If it is your father's self acquired no one has got right over the property.  If it is ancestral then everybody has got, but during the life time of husband wife cannot seek share in the husband's share in the ancestral property, but when sons claim then one share will alloted to the mother also.

Dear Kishore,

You have not specified that whether your mother had earned any amount ?

As you have wrote that your mother contributed to this property.

If she had any monetary contribution to this property you can put your right registered with consent of your father,if he denied the same you can proceed as per your right in the law.

just like any mother would,, she contributed her salary , but we dont have any proof, since she always

wanted this house to be mine and my brother,,, since my fathers marriage was surprise to us ,, and we did

not know abt it,, now we are worried that the property has to be shared with his second wife in the

future,, but my father he has promised us that this propery belongs to me and brother only ,,, but  we

dont beleive him anymore,,but he has told us that this property only belongs to us only ,,now how can we

make sure that this property can be only ours,,,, and my father also said that his second wife is not

behind the property and donot want any share in the future,,, but how can we make sure that only me and

my brother be the owners of this property,,, and how can we make sure that in the futre his second wife

should not try to claim this property.

Don't worry too much in this case,You seems to be emotional in the case. It happens everywhere.

As far as property has concern you take the consent of your father in writing under advice of any legal expert in your area and make his second wife as the confirming party and the document should be registered or notarised for the safe side of your family.

Hello

Last five months ago I had purchased agriculture housing plots and were registered at sub registar office. After some time I have got Encumberance Certificate also. Is it enoug for protecting my plots ? Any legal actions to be taken? Please suggest... Ramesh Kopalle
