Property share

Dear Experts,

My father constructed ground and first floor house in Karnataka through his earnings and bank loan.

He expired in 1988 leaving behind wife, two sons, two daughters (one married)

and subsequently for my second sister's marriage  my sisters and my brother gave a power of attorney to my mother to sell the first floor property to me. Absolute Sale Deed was registered. 

Subsequently I have constructed 2nd floor by spending my savings.

My elder sister expired in 1998 leaving behind his husband, one son and one daughter.

The ground floor portion Khatha is in my Mother;s name. 

 

1. All of us want to transfer the property to our mother.

2.My brother-in-law has remarried after my sister's death. Now his son and daughter are both majors.

3. My younger brother has a son and recently my brother's wife has applied for a divorce

4. My brother has given me a power of attorney for his share in the property.

Kindly let me know:

1. Whether my deceased sisters children should sign the document for transferring the ground floor portion in my mother's favour ?

2. Whether my brother's son has any right in the property and whether he can create any problem because his mother has applied for divorce ?

3. Whether I had the right to construct 2nd floor portion on the first floor which I have purchased from my mother , sisters and brother through absolute sale deed ?

I have gone through the forum and considering the previous posts in the forum,I am really confident that my queries will be replied by experts.

Your brother's son will definitely claim his share in his father's and grandmothers's property.
