QUERY

Hi,

I got married in 2007.We stayed with each other for one year. But during one year of marriage he continually demanded dowry and used to harass me. When I refused to leave him he left me and took transfer out of India with out informing me. It is almost two and half year that he is not coming back and not responding. I have filed FIR against him but he is not responding to the FIR also. Please advice what further action could be taken to get divorce and maintenance from him?

In the given facts, it is difficult to wait for him and persuade him to reside with you so get a divorce by filing a petition before family court and got the notice published in newspaper and court shall provide you ex-parte divorce decree as desired.

IT IS BETTER TO FILE DIVORCE PETITION IN FAMILY COURT.IF YOUR HUSBAND IS ABROAD PLEASE FOLLOW THE PROVISION FOR SERVICE OF SUMMONS  WHICH ARE LAID DOWN IN CODE  OF CIVIL PROCEDURE AND CIVIL MANUAL. IT IS ALSO BETTER TO APPROACH ADVOCATE

file a divorce case if you both are HINDUS................that your husband has left you and its been more than 2 years and there are no conjugal rights b/w you both since two years.... but it would only be possibe if you both have no co-habitation under one roof..........not even for a single day/night...........you can also attach the copy of FIR that would help in your case.....but have you filed FIR or just intimated POLICE by simply writing a complaint....??? ask Police as well what steps have been taken on your complaint, what authorities the police has contacted to bring or compell your husband to appear................if not personall...... file an RTI...........................application..... and approach a good lawyer....ASAP

you must know his office and office address. chess him through his office - if it is known to you.

you may send summon of court/police to his office address also.

don't you know his home address or relatives of him?
