Question on a redevelopment project

Hello

In a redevelopment project people have vacated their houses and are being provided rent from the developer for a temporary alternate accomodation. 

The new strucutre is ready and some people for want of shelter and a feeling of insecurity have come back in the new redeveloped strucutre  even when the OC is not obtained by the developer.

There are many cases pending in the courts regarding the redvelopment.

Is it advisable to return back even without OC being obtained?

For those who have not come back ,  are they eligible for receving rent from the builder.

I mean to say is it justified to receive rent from the builder till OC is obtained ?

1.  The local civic body levies penalty of Rs. 2500/- for occupying flat without OC.


2.  The terms of the redevelopment agreement will determine the rent amount egilibility in respect of possession before OR after of OC.

You cannot occupy the redeveloped building without OC and it is the duty of the builder to obtain OC, hence until he obtains it for you, you may continue to receive rent.
