Regarding installation of solar panel

 i am an 78 year old person ,i have a  layout in a village in cuddalore district in which 1/3 of plots were sold before  the cut off date and 2/3 is unsold .one of the plot owners had purchased two plots say no 5 and 6  he had not applied for approval for these plots and he had occupied two of the adjacent plots of my unsold plots and installed solar panels  without my permission .i did not go to my village since two years and due to ill health i cant go to the village now. i want to know how the EB department had given permission for installation of solar panel in unapproved plot .what can be done regarding this problem please inform.

If you have sons or daughters you can ask any of them to visit the plot and speak to the person and try to settle the matter amicably. If the person fails to take any action you have to file injunction suit against him.

To know whether EB dept had given permission to him to install solar panel or not, you have to write to them or apply under RTI Act for the information.

Respected Mr. Jambulingan,

As I understand from the query you have shared here that one of the plot owners has set up solar panels on an adjacent unsold plot owned by you without your permission.

It is immaterial whether EB had granted permission or not, it is your property and no one can intrude into your property and stay for whatever purpose.

I suggest that:

  1. Issue a formal letter protesting his illegal act and immediate vacation from your property.

 

  1. If after a reasonable time of 15days, he still did not vacate your property, and did not reply to your letter or otherwise communicate to you about the matter, please prepare a general power of attorney in favour of your known person in that place since your health does not permit your movement.

 

  1. Also, ask the designated person to discuss the issue in presence of preferably at least more than two members of Panchayat and the trespasser shall be heard.

 

  1. After the discussion, record the conversations in the Panchayat Nama.

 

  1. If the issue doesn’t get resolved I suggest to fix a lawyer to give legal notice for criminal breach of trust and illegal occupation of property for recovery of reasonable rent for period of occupation, cost of damage to the property and legal cost incurred.
