Service mark

Dear All,

I understand that there is much similarity between a service mark and a trademark. However, I want to know if the process of application for a service mark is different? Or if some thing special is to be written in an application for a service mark? Or whether, after applying under the same application, the mark SM can be used?

Service Mark is Trade Mark itself and it is not different from Trade Mark. In certain countries, the trade names products such as packaged products are termed as trade marks and the trade names of services are termed as service marks.

In India, both are the same and there is no difference in the process of application. You have to mention the class of the service/goods as per the classification given in Trade Marks Act.

Thank you sir. But if an application has been made in tm-i and ar etc, and the services were mentioned therein, can the mark SM be used? or was there a requirement of mentioning the same in the application?

Mr. Vibanath,

TM office has divided various goods and services in to 45 classes.


35 goods/ products

10 services (including software / legal etc.,)

Yes, you can use SM above your logo. I mostly my advice clients to use SM wherever applicable.

So sir.. from what I understand, there is no need to mention anything to the effect that the application is for a service mark in the application itsellf. Your reply is quite a help.

hai VIBHA! so you can have 2 marks, 1. is service mark(given to group of persons who is doing same business) 2. is your own Trade Mark. Bu my sugession is whenever,wherever possible use both marks. hansa.kashyap@yahoo.co.in

You can see the classification yourself... if you apply for classes 1 - 35 it can be referred to as Trademark


if you apply for any class from 36 - 45, it can be referred to as Servicesmark


In general people understand trademark and servicemark as one, there is not much difference.

THE FOURTH SCHEDULE TO TRADE MARKS RULES, 2002

Classification of goods and services – Name of the classes

(Parts of an article or apparatus are, in general, classified with the actual article or apparatus, except where such parts constitute articles included in other classes).

Sir I am aware of this classification. But my question is only whether this thing has to be specifically mentioned in the Application one makes that the same is for service mark?

Or does it automatically mean that one is applying for an SM when one applies for registration for services?

No need to mention anything.. It i a technical understanding... If you have good knowledge you understand how to differentiate between Servicemark and Trademark
