Stages in Appeal in 138 NIA Conviction Cases

Once the accused has filed an appeal in DJ against the conviction by Trial Court, what are next stages in the hearing of the appeal?

Does it go to Direct Arguments or a written reply is required from the side of the complainant (now the defendant)?

It is up to you.  If you want to file reply to the appeal in writing, you can file the same and argue the matter.  Otherwise, in appeal, the appellant is to argue first, you are to rebut the arguments.

once the appeal is filed these are the stages

1. issue notice to complainant/respondent

2. Call for lower court records

3. Argument by the appellant/accused

4. as cited by Mr. Dalip Singh the reply by respondent either oral or written agruments

5. Sentence
