statutory arbitration

hi sir/madam,

   can i get some relevant cases on the point, of payment of stamp duty, under Article 11 of Karnataka Stamp Act, whether it exempts the statutorily reffered Arbitratrion. whether the stamp duty needs to be paid incase, the reference is made by the statutory provision. i came to know from an Karnataka HC Judgment that, in case of court refererence of arbitration the matter, the stamp duty is exempted.

The Schedule to the Indian Stamp Act, 1899

 


contains a specific provision in Article 12 mentioning the stamp duty

payable on ‘arbitration awards’. Sections 33 and 35 of the Stamp Act are

thus attracted if the award is not stamped or is insufficiently stamped.
