Stay on domestic violence

Dear Sir,

My wife filed 498a, DV, RCR, Maintanance cases in her home town in AndhraPradesh and i filed divorce case in Karnataka where i am working.

 

Except divorce case that i filed, remaining all cases she filed in Taluka Court ( JFCM Court). She filed Maintanance cases as well. 

Now i want to get Stay order on Domestic Violence? my question is  Do i need to apply in sessions court or Can i request in same JFCM court for stay order? or do i need to go for higher courts for stay order?

Dear Querist

You may file an appeal before session court u/s 29 of D.V. Act against the summoning order within 30 days from the receiving of summon.

If you would like to obtain stay of the proceedings of the DV case, you have to approach high court only and not sessions court.

Mr.kalaiselvan is right..i did so,but now in Hyderabad high court bench is not faver of men gender. Even though you show valid reasons Mr.Sunil chowdary says..she is lady..give one more chance... But try your luck ..good luck
