trespass

My neighbour has without my permission cut tree whuch was inside my house it was protuding earlier we had trimmed it but now when we were not present at home he has cut it completely what legal action criminal civil can be taken within how much time

according to Indian Forest Act, the penalty for cutting down a tree is Rs. 10,000 or 3 months imprisonment. This punishment may extend up to one year under various state acts.

Besides since he has entered into your property without your permiwssion for this purpose, he can be booked for the offence of criminal tresspass too. 

Contact a lawyer. You have a civil right for damages. The measure would be at least the value of the tree. Based on local law, there may also be a crime for trespassing and damaging your property.

Even if one has to cut a tree for genuine reason permission of competent authority will have to be obtained. The competent authority for the purpose will depend on the place of your residence.
