1. Matter u/s 138 will run & conducted independently of the "insolvency petition"
2. Matter u/s 138 is a "criminal matter".

Cheque bouncing is punishable offence so accused of such offence can not escape from the cosequences of cheque bouncing and ipunishment merely on the pretext of filing insolvency petition.
