Under section304-b ipc filling of bail application

under section304-b ipc , a case has been committed to session court.main aacused is in judicial custody. can bail bail be granted by session court  directly without going first to the court of magistrate.

If the accused is under judicial custody then he can approach the trial court alone for obtaining bail.

If the trial dismisses the bail application then he can approach the sessions court or even high court.

If the accused is in the jail then he should approach  for his bail in the concern trial court , if the bail is dismissed there then he can move to the session court .

Yes, the Sessions Court is empowered to admit accused in bail in a case under section 304 B IPC, without being filed / considered (application for bail) by Magistrate.
