Unknown nominee by my father in bank accounts

After my father's death I got access to my father's account who is a pension holder of Govt of Orissa. In some of flexi accounts like Orissa state co-operative banks, I find names of unknown persons in the nominee column. My mother is alive & the only rightful heir of my father's property. I have requested three branches of the bank today intimating the loss & asking to freez the accounts pending submissions of necessary documents like death certificate, legal heir certificate, pension papers etc. One branch readily accepted my request. Another branch first hesitated to accept my application citing that only nominee can apply for such freezing of accounts. They intimated me that they are going to handover balance of deposits to the nominee if there is no court order. I just informed them that the death certificate is yet to be received, Further as an habit my father use to nominate with out intimating the person to whom he nominated. I found my name in many of the accounts which I never knew. In any case, we all sons & daughter of our family taken oath to cancel all such nominations & our mother should be the rightful owners/heir to our father's property!

 

Second branch after sometimes telephoned me & asked to submit my proof of identity immediately else they would pay the balance to the nominee. I was bit surprise. None perhaps claimed & death certificate is yet to be generated! Why the bankers are so desperate?

I just wanted to know the rights of my mother the true legal heir & the so called nominees in some accounts who neither known to our family, nor belongs to our caste & possibly may be relative to to the bank employees or may be some vested groups! I hope I would be guided on legal standings!

Submit KYC docs of yourself (Nominee) to the BM of the bank who have asked for it, immediately under proper acknowledgment.

Submit a notice (if reqd. legal notice) to the BM of the bank, with a copy to Circle/Area/Regional  Manager, MD, Chairman, Nodal Officer with a  copy to BO/RBI , immediately by email followed by redg. Post, under proper acknowledgment, and inform that nominee is not a legal heir and legal heir shall stake the claim and payment of deceased depositor a/c should be paid to legal heir only.

Attach death report of hospital/doctor, cremation certificate, receipt of fee paid/acknowledgment of having applied for ‘Death Certificate’ and affirm that on receipt of death certificate the same shall be produced.

 

If you have applied for only one copy of death certificate, increase the number of copies to sufficient number.
