Unregistered GPA

A property is up for sale. Said property is registered in the name of a person X. The person X was abroad when the property was bought. To facilitate buying that property X had given a notorished GPA in the name of Y (who is X's brother) but the GPA was not registered.

Now, X is selling that property. As a potential buyer what are the risks associated in this transaction?

Dear Sir,

needs much clarity on your query.

assuming that:

If GPA is unregistered by virute of it if the sale deed was registered -  it will not be registered by the Sub-registrar's office.

as said above, mistakely or inadvertatently registered it is having a technical defect which can be cured.

 

the property which is being put for sale in such an condition of issue it can be purchased curing the tecnical defect getting executed by Vendor as well as GPA holder and earlier vendor as witness for sale transaction.

But whenever a query is raised in a forum or before a attorney pls. ensure of furnishing all the details otherwise the query will not resolved even if resolved it will be lead to further queries.

sir    when property was bought  x was abroad  and he gave unregistared G P A  to y , soon the property was bought on the name of x and was registared on the name of x the  G P A given earlier by X become inoperative. As the property purchased is on the nane of x and as the prperty is registared prperty ,I dont find any problem for purchasing the said property as it effectively convey the title  . kalvala suguna prasad Advocate KHAMMAM

It will not be registered by the Sub-registrar's office.
