Withdrawl cash stolen inside bank in front of counter

If an account holder withdraw money from his/her saving account and money stolen inside bank premises, what to do? informed to Police for investigation but we found there is no CCTV inside bank to indetify the theft.

How can I get my money back?

Is it come under consumer Act as bank has not provided the proper security as service to the customer to safeguard their money inside bank premises.

You have narrated what has happened... The responsibility of banker ends the moment cash has been parted to you... Let the matter be investigated by police... I have not seen any guidelines to instal CCTV in every branch of the bank..However,  Let me find out from RBI website... You have not mentioned whether any Secuirty Guard posted at the branch? Any how please request the branch manager and other officials to help in completing the police investigation.

In most of the banks the top management was sitting on proposals of safety sent by branch heads. "The management is reluctant to incur this additional cost on safety measures and they are comfortable to claim insurance cover for damages.

Learned experts/members have given valuable advice. Kindly follow it.

Once collected from bank customer is expected to keep the belongings safe.

In many of the states Police Commissioners/SSP’s had issued advice/circulars to establishments to install CCTV in the premises.

You may obtain the copy.

Regular and periodic cheques are conducted in the banks also and Police beat Official signs in the register kept with the bank and carried by them.

Banks may be saving money but it does not mean that it shall allow pick pocketers in the bank and allow them to leave also.

You may find the following interesting.

In a branch of nationalized bank (Punjab and Sind bank) there was no CCTV, permanent Security Guard. The grill and Door to Locker room needed to be replaced. The branch was prone to theft. The thieves broke open the grill, doors, lockers and looted everything.

Bank claimed that it is not responsible for belongings inside the locker as per agreement with locker holder who is allotted locker on rent.

Everyone including the municipal councilors, MLA’s, community leaders, unions, media, welfare societies jumped into the matter, roads were blocked and there were Dharnas etc.

The bank is at fault and now had agreed to compensate the locker holders in principle, and the bank shall have to.

We will see to it that bank does not shun its responsibility.

When you are made to suffer due to negligence, deficiency of any sort by the banks/establishments, unite, shout and bite or you won’t be compensated.

Thanks for bringing the incident of lockers for the information of members... In the present instance mentioned by Queriest there were no details of the location of the branch of the bank for making detailed comments/suggetions... If details of modus operandi are  stated, we can guide the queriest.

Thank for the replies. The incident mentioned as below:


The robbery happened in Canara Bank, Mehrauli branch, New Delhi on sixth of March, 2013 at around 12:45 PM to 12:50PM from a saving bank account holder who withdrew large amount of money of Rs 1, 28, 960 and wanted to close the account. The bank staff misguided to the account holder to withdraw the whole cash to close the account. The bank staffs are well known about the fact of CCTV camera not installed in bank and targeted their customer who are alone and withdraw large amount of money. Not even bother about the loss happened to the account holder of the bank in the same branch.

There is one security guard stading inside the bank near to entrance and properly trained as he allowed outsiders after the incident happened.

The incident happened in front of the counter when the customer went to update the passbook for closing a/c after withdwaring the cash, the staff told the customer to wait for 2 min and in the mean time robbery happened as another customer came and he divert the mind by talking with that customer as he is regular  coming to bank.


If a customer was alone and spend around 1/2 hour to get his/her FD's en cashed and after with drawl loss his/her money  within 2 to 5 min inside the bank at the counter, who would be responsible for it. I strongly suspect the bank employees involvement as per their attitude and response towards their customers.

Security in bank

Where a locker was alleged to be already open and the ornaments therein were missing, the conduct on the part of the bank in not conducting any departmental enquiry nor being able to produce evidence as to the details of persons who have accessed the locker, the Commission held, in the light of the decision of the National Commission in Punjab National Bank, Bombay v. M.B. Shetty (FA No. 7 of 1991 decided on 06/08/1991) that the bank has been deficient in providing service and allowed the complaint in part. Ugam Singh v. GM, SBI & Ors. 1996 (1) CPR 188 (SCDRC-Rajasthan)

The complainant claimed from the bank an amount of Rs.45, 000/- with interest since he was robbed at the counter of the bank on his visit to deposit the amount in his current account. The bank was held responsible for deficiency of service under Section 2 (1) (o) on the ground that ensuring safety of the money to be deposited and/or withdrawn inside the bank premises is implicitly part of service rendered by a bank to a customer. Sir, please guide how to do and what to do as bank staffs says they informed their management many times about the cctv but management has not taken any step yet.

there is only one guard and if he will go on leave there is no one in place of him.

I can't believe, In todays high technology world, a bank has no intension about the customers safety as well as their safety of their money.

I am unable to open the RBI link provided by you... It is strange for Canara Bank not to  have CCTV at their branches in New Delhi... Please lodge compaint to their Head Office and also their Zonal Office at New Delhi... You can get the address from google... I will certanly guide you once I read RBI link... Regards
