    Hello MR. SACHIN BHATIA Suppose there is a partnership firm named XY Services & the partners are Mr. X & Mr. Y. But for some legal constraints Mr. X & Mr. Y want to transfer their ownership to Mr. A & Mr. B but want to have the firm name same i.e. XY Services. Is it possible to change the ownership without changing the firm's name ? If YES then How & if NO then Why ?

    CASE STUDY Dear sir, I have an important case to present in front of you.. That a person burrowed a sum of some amount as, Loan no -1, ( House building loan)from a bank,.by mortgaging his house registered in his nameThis loan was subsequently paid by the co borrower, - his wife and the account was kept standard after the death of the burrower. Now the deceased man’s had 2 sons and his wife as legal hire. The man then had made a will where he had wished his wife as the sole beneficiary of all the land and house and his assets. The youngest son had taken loan from the same bank without any co lateral or mortgage while his father was alive. The father or mother did not stand as a guarantor or burrower to this loan. The loan was taken to start a small scale industry which was covered under an insured coverage of cental govt ( C.T.G.S.M.E) where one time & the annual insurance fees was regularly paid. Subsequently the second loan taken by the younger son went bad and was sent to the DRTA .Now the second son kept no contact with the family since last three years before the death of his father. The Bank was quiet these years and never wrote to the father , mother or any one about the son’s loan from the date of its sanction or its failure. Now after 3 years after coming to know that suddenly the father has died they are assuming. to take the mortgaged property for loan no -1 keeping into view that the younger son is the legal hire to his father’s property though for this loan the father never had mortgaged the house nor an extension of mortgage was done or the father stood as a guarantor for the loan no -2 during his life time.     i am working as a lecturer in a permanantly nongrant institution.in advertisement institution said that payment will be as per ugc norms and they didnt mention the nature of appointment will be of CONTRACT BASIS. i was selected trough a selection commitee.the college gave me order of appointment with a fixed salary of 8,000 rs. also i got approval from university of probation of 2 years . it is injustice that other colleagues whose educational qualification are exactly as per my qualification are getting higher salary .can i claim a case on institution? can i demand full salary with areares from last two years?

    When bank sell mortgaged property of borrower on account of default makes sale deed and purchaser pays stamp duty on registration deed but whether any deemed sale can be treated between borrower and bank for levy of stamp duty? if yes who is liable to pay stamp duty? Borrower or bank or purchaser? Question is for Gujarat State. Please make it clear that bank has made sale deed to purchaser and is registered with sub registrar and stamp duty is already paid by purchaser on this deed. I am asking that whether any deemed sale deed presuming borrower as seller and bank as purchaser can be presumed by sub registrar for levy of stamp duty on deed which is not in existence ? A.G. Audit has raised point before stamp duty Office that such deemed stamp duty should be collected (short levy of stamp duty u/s 32A) and that too from purchaser. Is it legal?
