I have lended 42000 from my friend in cash & gave him a post dated cheque of the same amount. After one month he told me that the cheque has been lost. I told him that please give me rs. 8000 & I'll provide you a cheque of Rs. 50000. he agreed & I have provided the cheque. After one month he has submitted the cheque of Rs. 42000 in bank & same amount has got realized. After that I had made an stop payment for the next cheque. Now he has filed a case of 138. What should I do?

have you admitted anywhere in writing to him that you have taken Rs. 50000/- cash from him and he had issued a cheque against that????
