498a has lowest conviction rate

Now it has come out officialy what has always been said in this forum  -  mostly 498a is currently  being used by wives to harass and and terrorise husband and their families

 

As per latest statistics from National Crimes records bureau for year 2009.  Section 498a  has  second lowest conviction rate in india compared to all other criminal section. The only other section under which there was lower conviction was arson  (IPC 435, 436 and 438) and that too beat 498a by mere 0.3%
 
Here is hard statistics for year 2009 
 
1. Conviction rate under 498a ( across India) 19.8%
2. Lowest Conviction rate under any IPC -  arson ( IPC 435, 436, 438) 19.5 %
3. Highest criminal conviction rate( other Criminal IPC) 53.6 %

some ppl talk about 498a having conviction rate of 5%?? Guess they were wrong.....

It would be interesting to see replies for the feminist fraternity on this forum :-)

 

As per them, this law bring equality but in my view this is disturber of harmony (without any fool proofing) !!

5% conviction should be  correct number  because.

 

1. Above statistics does not include componded/ complaints taken back.

2. Above statistics is only from lower court  - it is well known that lower court takes conservative approach and pronounces many people guilty, most of such judgments are overturned latter in the higher courts.

 

But irrespective of these nuances - most importantly - 498A HAS LOWEST CONVICTION RATE OF ALL IPC
