VERY GOOD MORNING !
1. In case a person was driving vehicle on main road. Suddenly without any notice, other person comes across the road. The driver not able to control the vehicle, dash the person and he died instant or sustain major injuries.
Question: Does it amount to Culpable homicide, what would be defenses of the driver. Is driver punishable? But it is not negligence of driver.
