Adjudicating Officer to conduct hearings of IT Cases at Nagpur

The civil disputes under Information Technology Act, broadly known to general public as ‘Cyber Civil Wrong”, is dealt by special court known as Adjudicating Officer.

The Hon. Adjudicator Maharashtra i.e. Information Technology Secretary Maharashtra has decided to conduct hearing at Nagpur , in the matters filed by complainants in the Vidarbha region. He has fixed 14 December 2016 as the hearing date for most of the matters pending before him.

This is very welcome move on the part of Adjudicating Officer to conduct hearing at Nagpur so that complainant/legal representatives can remain present and save their time as well as money.

Normally the hearing is conducted at Mumbai and it makes very inconvenient for complainant to bear the expenses of litigation to be defended at Mumbai when the crime happens at Nagpur and he is residing in Nagpur.

It is long pending demand from many cyber legal practitioners across Maharashtra that the adjudicating officer should establish his office at every district place so that victims will be able to file complaint more conveniently and there will be less litigation expenses to the complainant. Presently as there is only one office at Mumbai many complainants get discouraged and are compelled to give up the judicial remedy which amounts to denial of basic right of easy accessibility to justice.
