To the best of my knowledge, nobody can use the official sign of Indian Currency in any Logo or advertisement as it is the sovereign symbol of the currency. You may report the matter to the Ministry of Finance with a copy of a photo of the Logo, details of the company using it. Mark a copy to Reserve Bank of India. You can expect to get a reply from the Ministry of Finance if you address it directly to the Minister by name.

Yes they can until it do not contradict the Trademark Act, 1999 and the Paris Convention. The fact that rupee symbol cannot alone i.e. word or letter or wordmark be granted registration and may the company apply for registration with a disclosure that it won't have any exclusive right on the rupee symbol.
