Ancestor property grandson rights

Its a big story with my family. My father was having about 174 acres of land

few moneylenders (friends) cheated him and grabbed all his property in penny's. Now he doesn't have even his own home for living. Is there any provision in law to fight against this?

Can I claim for my grandfathers property. Can my father do something ?

This is happened 10-12 years before. Is there any chance by which i can get my share and the cheaters will get their punishment?

It will be very greatful of you lawyers if I can get any help in this.

Hi Vinay,

How did the moneylenders grabbed your father's property ???? Did they do a fradulent or forced transfer ? or they got a court decree ?

Secondly as regards your right on grandfather's property - is the property self acquired or ancestral ?

answer to the first que:

not exactly. But my father needed money. He borrowed from money lenders and couldn't return to them within a time period . So he had to pay them in this way. This is the very old technique of the money lenders. they gives loan on high interest rates and if the person could not repay them in time they will get the property.

As much as i know my father gave them signature on blank stamp papers before taking money. It was very common that time.

There were many similar cases in Vidarbha region when many farmers did the sucide because of such scam. I guess mr. RR Patil requested some kind of act by which we can get our property back. but not really very sure.

ans to your Second Que:

Few acres were bought by my father and few by my grandfather. I have two uncle who has equal right on the property but they are passed away.

The land is aggricultural land is one of the best quality land in entire region.

Thanks for looking into the issue. I hope my inputs are correct to your questions.
