Anticipatory bail

Dear Sirs,

Friend of mine was working in company-X , on probation, after six month he did not made permanent ,

Repeated requests were made for permanency   but it did not materialized,  and he had been suspended from the job.

After few days - he had been called by the company and alleged some forgery and chitin, and asked him to confess - if not confessed  , then threatened him that they will file an FIR against him.

He is very afraid and upset after that, because he got new job, 

My question is - Should he apply for Anticipatory bail?  if yes, then His office was in Mumbai, he stays at Thane, where he should he apply for in Mumbai or in thane.?

What are the chances of gating AB in this matter ?

You should have strong reasons to believe that the person may be arrested in connection with the  aforesaid case.And that the police have already registered and started enquiring about such case and the person apprehends that he may be arrested in connection with the said case only then you shall proceed with the Anticipatory Bail, you have to have the P.S Case number where the cause of action arose.

he can be filed AB before session court or High court u/s 438 of Cr.P.C
